 PART I PRELIMINARY
  
  hort title and application
  This Ordinance may be cited as the Money Lenders Ordinance.
  This Ordinance shall have effect notwithstanding any agreement
to the

  nterpretation
  In this Ordinance, unless the context otherwise requires--
  pany" means a body corporate--
  incorporated under the Companies Ordinance (Cap. 32);
  incorporated by any other Ordinance; or

  qualified person" means a person in respect of whom there is in

  For the purposes of this Ordinance, where by an agreement for the
loan

  For the purpose of determining the amount of the principal of a 
loan,
  amount thereof which is not shown to have been lent except for

repayment

  References in this Ordinance to an assessor are references to a

  The Governor shall appoint a public officer to be the

  The Registrar shall establish and maintain a register in 
which he
  l cause to be kept particulars, other than specified particulars,
of--
  applications for the grant or renewal of licences; (Amended 69

  licences which are in force or have been revoked or suspended;
  such other matters, if any, as he thinks fit.
  In this section "specified particulars" means particulars 
furnished
  r section 8 which are specified in regulations made under 
section 34
  articulars which shall not be entered in the register.

  Except as may be necessary for the exercise or performance 
of any
  tion or duty under this Ordinance or for carrying into 
effect the
  isions of this Ordinance, the Registrar and every person 
employed in
  ying out or in assisting any person to carry out the 
provisions of
  Ordinance--
  shall preserve and aid in preserving secrecy with regard 
to all
  ers relating to the affairs of any person that may come 
to his
  ledge in the exercise or performance of any function or duty 
under
  Ordinance;
  shall not communicate any such matter to any person other 
than the
  on to whom such matter relates; and
  shall not suffer or permit any person to have access to any records
in
  possession, custody or control of any person to whom this 
subsection
  ies.
  
  Subsection (1) does not apply--
  to the disclosure of information in the form of a summary of 
similar
  rmation provided by a number of persons if the summary is so framed
as
  revent particulars relating to the business of any particular 
person
  g ascertained from it;
  to the disclosure of information with a view to the institution
of, or
  rwise for the purposes of, any criminal proceedings; (Replaced

  in connection with any civil proceedings arising out of, or 
relating
  section 22, 23, 24, 25, 27, 33, 33B or 36; or (Added 69 of 1988
s. 5)
  to the disclosure of information to the Financial 
Secretary, the
  etary for Monetary Affairs, or any public officer authorized 
by the
  ncial Secretary for the purposes of this paragraph where, 
in the
  ion of the Registrar, it is desirable or expedient that

  Any person who--
  contravenes subsection (1); or
  aids, abets, counsels or procures any person to contravene
subsection
  commits an offence and shall be liable to a fine of $ 100,000 and 
to
  isonment for 2 years.
  nspection of register
  Any person shall be entitled on payment of the prescribed fee--
  to inspect the register during ordinary office hours and take 
copies
  ny entry; or
  to obtain from the Registrar a copy, certified by or 
under the
  ority of the Registrar to be correct, of any entry in the register.
  The Registrar shall give public notice, in such manner as he may 
deem
  of the place where and the times when the register may be
inspected.
  Documents admissible in evidence
  cument purporting to be a copy, certified by or under the
authority of
  Registrar to be true and correct, of any entry in the register

  dmissible in evidence in criminal or civil proceedings 
before any

  ed, the court shall presume that--

 PART II LICENSING OF MONEY LENDERS
  
  estriction on carrying on of business of money lender
  No person shall carry on business as a money lender--
  without a licence;
  at any place other than the premises specified in such licence;
or
  
  rwise than in accordance with the conditions of a licence.
  A licence shall be in the prescribed form.
  pplication for licence and public notification of application
  An application for a licence shall be made to the Registrar in 
the
  cribed form and in the prescribed manner, and shall be accompanied 
by
  prescribed fee and a statement in writing containing the 
prescribed
  iculars in respect of the application.
  An application made under this section in respect of a company
may be
  by any person authorized in that behalf by such company. (Amended 
69
  988 s. 7)
  An application made under this section in respect of partners 
in a
  may be made by any such partner.
  The Registrar shall, in such manner as may be prescribed, give 
public
  ce of every application made under this section.
  nvestigation and lodgement of applications
  Where an application is made under section 8, the applicant 
shall at
  same time send a copy of the application to the 
Commissioner of
  ce, and the Commissioner of Police may cause an investigation 
to be
  ied out in respect of the application for the purpose of 
determining
  her, in the opinion of the Commissioner of Police, there are 
grounds
  objecting to the application under section 11.
  For the purpose of carrying out an investigation under this 
section,
  Commissioner of Police may in writing require the applicant to
produce
  inspection such books, records or documents or to 
furnish such
  rmation relating to the application or any business carried 
on or
  nded to be carried on by him as the Commissioner of 
Police may
  ify.
  In respect of an application made under section 8, no step other 
than
  registration of such application shall be taken by the Registrar
prior
  
  the date on which a period of 60 days after the date on which 
the
  ication is made expires; or
  the date on which the Commissioner of Police notifies the 
Registrar
  any investigation carried out under this section in respect of 
the
  ication has been completed, whichever is the earlier (in this 
section
  rred to as "the material date").
  Where the Registrar or the Commissioner of Police intends to 
object
  r section 11 to any application for a licence, he shall, not 
later
  7 days after the material date, serve notice on the applicant of 
his
  ntion to object and of the grounds of such objection; and where 
such
  ce is served by the Commissioner of Police, he shall send a 
copy
  eof to the Registrar.
  Upon the expiration of a period of 7 days after the material date 
in
  ect of any application made under section 8, the Registrar shall
lodge
  application with such magistrate as he deems fit, together with
a copy
  ny notice served on the applicant under subsection (4).

  The Registrar shall give notice to the Commissioner of Police of 
any
  ement made under subsection (5).
  
  Licensing court
  Where an application is lodged under section 9 (5), the 
licensing
  t shall hear and determine the application in accordance with
section
  
  For the purposes of hearing and determining an application 
lodged
  r section 9 (5), the licensing court shall be constituted by-
-
  where no notice has been served on the applicant under section 
9 (4)
  1 (2) (b) (i), subject to subsection (3), a magistrate sitting 
alone;
  
  where a notice has been served on the applicant under section 9
(4) or
  2) (b) (i), a magistrate sitting with 2 assessors.
  Without limiting the generality of the power of the licensing 
court
  r section 10B (f) to adjourn the hearing of an application 
lodged
  r section 9 (5), the licensing court shall, where--
  it is constituted by a magistrate sitting alone; and
  it grants leave under section 11 (2) (b) (ii) to a person to object
to
  application, adjourn the hearing to another date to be 
heard and
  rmined by the licensing court constituted by a magistrate sitting
with
  sessors.
  Where the licensing court is constituted by a magistrate sitting 
with
  sessors, the decision of the licensing court shall be that 
of the
  rity of the members and shall be recorded in writing:
  ided that the magistrate's rulings on matters of law shall bind 
the
  nsing court.
  The Registrar shall be provided with a copy of each decision of 
the
  nsing court. (Replaced 69 of 1988 s. 9)
  Selection of assessors and payment of fees to assessors
  Where under this Ordinance the licensing court is required 
to be
  tituted by a magistrate sitting with 2 assessors, the Registrar
of the
  eme Court shall select those assessors.
  Where an assessor selected under subsection (1) attends the 
licensing
  t for which he has been so selected, he shall, irrespective of
whether
  its as an assessor, be paid a fee of an amount equal to the fee 
fixed
  r section 7A (2) of the Magistrates Ordinance (Cap. 227) to be
paid to
  ssessor for his services. (Added 69 of 1988 s. 9)
  Powers of licensing court
  ect to this Ordinance, the licensing court may determine 
its own
  edure and in particular may--
  receive and consider any material, whether by way of oral 
evidence,
  ten statements, documents or otherwise, notwithstanding 
that such
  rial would not be admissible in evidence in civil or 
criminal
  eedings;
  by notice in writing signed by the presiding magistrate, require 
any
  on to attend before it at any hearing and to give evidence and
produce
  ments;
  administer oaths and affirmations;
  examine on oath, affirmation or otherwise any person attending 
before
  t any hearing and require such person to answer all questions put 
by
  ith its consent;
  determine the manner in which the material referred to in
paragraph
  shall be received; and
  adjourn any hearing from time to time as it may deem fit, and may 
do
  things--
  ancillary to the powers conferred by this section; or
  reasonably necessary for the discharge of its functions under 
this

  Immunity
  -
  member of the licensing court; and
  witness, party to any proceedings, representative or other 
person

and

  Determination of application for licence
  The licensing court shall fix a date for the hearing of an
application

第一章 总 则
第一条 为了加强殡葬管理,推进殡葬改革,保护土地资源和环境,促进社会主义精神文明建设,根据国家有关法律、法规,结合本省实际,制定本条例。
第二条 本条例适用于本省行政区域内的殡葬活动及其管理。
第三条 殡葬管理工作坚持推行火葬,改革土葬,革除丧葬陋习,倡导文明、节俭办丧事的原则。
第四条 各级人民政府应当加强对殡葬改革工作的领导,建立殡葬改革目标管理责任制,大力推行殡葬改革。
殡葬设施建设和火化率应当作为考核文明城市、文明乡(镇)、文明街道的重要内容。
第五条 各级人民政府应当把殡葬事业纳入当地的国民经济和社会发展的总体规划,把殡葬设施的建设和改造列入当地的城乡建设规划和基本建设计划。
第六条 各级人民政府及有关部门应当采取多种形式,加强殡葬改革的宣传教育,普及科学知识,破除封建迷信思想,移风易俗,倡导丧葬新风尚,引导全社会理解、支持和参与殡葬改革。
机关、团体、企业事业单位和城乡基层组织,应当对本单位、本辖区的人员进行殡葬改革的宣传,教育本单位、本辖区的人员遵守殡葬管理规定。
第七条 省人民政府民政部门主管全省殡葬管理工作。
市(地)、县(市)人民政府民政部门主管本行政区域内的殡葬管理工作。
市、县设立的殡葬管理机构,受同级人民政府民政部门委托具体负责殡葬管理工作。
乡(镇)、街道应当有专人负责殡葬管理工作。
第八条 各级工商、公安、卫生、土地管理、规划、物价、林业等部门应当按照各自职责,协同民政部门做好殡葬管理工作。
第九条 各级人民政府及其民政部门应当加强殡葬工作队伍建设,提高殡葬职工的职业道德水准和业务素质,改善殡葬职工的工作环境和生活条件,切实解决殡葬职工的实际困难。
全社会都应当尊重殡葬职工的职业劳动。
第十条 对积极推行殡葬改革、取得显著成绩的单位和个人,各级人民政府和有关部门应当给予表彰和奖励。

第二章 火化推行与管理
第十一条 本省行政区域,全面推行火化。人口稀少、交通不便、暂不具备火化条件的乡、村,可以划为逐步推行火化区。其范围的划定,由市(地)人民政府提出,经省民政部门审核,报省人民政府批准。
逐步推行火化区的人民政府应当大力宣传、提倡殡葬改革,积极创造条件,逐步推行火化。
第十二条 各市、县应当建设火化殡仪馆。尚未建火化殡仪馆的市、县,应当自本条例施行之日起一年内建成,并投入使用。个别有特殊困难不能按期建成的,经省人民政府批准,可以适当延迟,但至迟必须在1999年底前建成。在火化殡仪馆建立之前,可以到有火化设施的邻近地
区火化。
殡葬设施、设备建设,应当符合国家规定的技术标准。
第十三条 非逐步推行火化区的人员死亡的,应当全部实行火化。
逐步推行火化区的常住人员在逐步推行火化区以外的区域死亡的,应当实行火化。
逐步推行火化区的国家工作人员死亡,有火化条件的,应当实行火化。
逐步推行火化区的人员死亡,生前遗嘱火化或者丧主要求实行火化的,应当予以支持,他人不得干涉。
少数民族公民死亡的,尊重其本民族丧葬习俗;自愿实行火化的,他人不得干涉。
第十四条 按照本条例规定应当火化的遗体,由丧主或者死者生前所在单位通知火化殡仪馆接运,向公安部门办理死亡证明手续后火化,但下列情况除外:
(一)在医院死亡的,由医院(含医疗机构,下同)及时通知火化殡仪馆接运遗体,并告知丧主或者死者生前所在单位办理手续后火化;
(二)因自然灾害、交通事故或者犯罪行为等造成的非正常死亡遗体,由公安部门通知火化殡仪馆接运,并告知丧主或者死者生前所在单位办理手续后火化;
(三)无名、无主遗体,由公安部门通知火化殡仪馆接运。
火化殡仪馆接到通知后应当及时接运遗体,并对遗体进行必要的技术处理,确保卫生,防止污染环境。
未经殡葬管理机构批准,医院不得将遗体送出院外。丧主擅自转运遗体的,医院应当予以制止,并及时报告殡葬管理机构。
第十五条 火化遗体应当凭医院出具的死亡通知书或者公安部门出具的死亡证明。
火化因自然灾害、交通事故或者犯罪行为等造成的非正常死亡遗体和无名、无主遗体,应当凭死亡地公安部门出具的死亡证明。
第十六条 遗体需要在火化殡仪馆保存的,应当办理手续,保存期限一般不超过7天;特殊情况需要延期保存的,应当经当地殡葬管理机构批准。保存费由申请人交纳。
因严重传染病致死的遗体,应当立即消毒,并在送到火化殡仪馆后立即火化。
第十七条 按本条例规定应当实行火化的人员在异地死亡的,应当就地火化;死亡地无火化殡仪馆的,应当就近火化。因特殊原因,丧主或者死者生前所在单位需要将遗体运回死者生前居住地火化的,应当持死者生前居住地市、县民政部门出具的证明,经死亡地市、县民政部门批准。


第十八条 享受丧葬费待遇、应当实行火化的人员死亡后,有关单位应当凭火化殡仪馆出具的火化证明,按省有关规定向丧主发放丧葬费。
无名、无主遗体的火化费用,按省有关规定执行。
第十九条 火化殡仪馆和其他从事殡葬服务的单位应当严格遵守殡葬管理的有关规定,加强内部管理,改善服务条件,确保服务质量。
殡葬服务单位工作人员应当遵守操作规程和职业道德,实行规范、文明服务,不得利用工作之便索要、收受财物,不得刁难丧主。
第二十条 殡仪服务收费项目和标准按省的有关规定执行。

第三章 骨灰处理与公墓管理
第二十一条 提倡不保留骨灰。
遗体火化后保留骨灰的,提倡在骨灰堂、骨灰墙(塔、廊)等骨灰存放处存放,也可以葬入骨灰公墓。禁止将骨灰装棺土葬。
第二十二条 公墓、乡村骨灰存放处、乡村公益性墓地建设应当统一规划,合理布局。
公墓一般以市、县为单位建立。公墓建设规划由省民政部门会同有关部门编制。公墓建设应当严格控制规模。
乡村骨灰存放处、乡村公益性墓地一般以乡(镇)为单位建立。人口较少、交通不便的地方,可以以村为单位建立。乡村骨灰存放处、乡村公益性墓地建设规划由市(地)民政部门会同有关部门编制。
公墓、乡村公益性墓地应当按照节约土地、保护山林、美化环境的原则建设。
第二十三条 建立乡村骨灰存放处、乡村公益性墓地,应当经乡(镇)人民政府审核同意后,报县(市)民政部门审批。建立公墓,应当经市、县民政部门审核同意后,报省民政部门审批。
建立公墓、乡村骨灰存放处、乡村公益性墓地应当依法向计划、土地、规划、林业等部门办理有关审批手续。
任何单位和个人未经批准,不得擅自建立公墓、乡村骨灰存放处和乡村公益性墓地。
第二十四条 公墓、乡村公益性墓地应当建立在荒山、荒坡、非耕地或者不宜耕种的瘠地上。
禁止在铁路、公路(国道、省道)、通航河道两侧、水库及河流堤坝附近和水源保护区、文物保护区、耕地、风景名胜区、开发区、住宅区、森林公园和自然保护区内新建公墓、乡村公益性墓地或者其他坟墓。
前款区域范围内已建的坟墓,除受国家保护的具有历史、艺术、科研价值的坟墓外,当地人民政府和有关部门应当制定清理计划,做好工作,有步骤地进行清理,通知丧主在规定时间内迁移、深埋,不留坟头。
第二十五条 公墓应当凭火化殡仪馆出具的火化证明出售墓穴和骨灰存放格位。禁止出售寿穴,但为死者的健在配偶留作合葬的寿穴除外。
严禁倒卖墓穴和骨灰存放格位,牟取非法利润。
第二十六条 乡村骨灰存放处、乡村公益性墓地按市、县物价部门核定的标准收取费用。乡村骨灰存放处、乡村公益性墓地主要存放本乡(镇)、村死亡人员的骨灰,不得从事经营性活动。
公墓的收费项目、标准由省民政部门提出,报省财政、物价部门审核批准。
第二十七条 严格控制公墓、乡村公益性墓地的墓穴占地面积。
公墓、乡村公益性墓地的墓穴占地面积与使用年限、墓碑高度与面积,由省民政部门提出具体标准,报省人民政府批准后执行。
第二十八条 逐步推行火化区内提倡遗体在乡村公益性墓地深埋,地面不留水泥、石块等建筑的坟头。
第二十九条 除本条例规定的公墓、乡村骨灰存放处、乡村公益性墓地外,禁止建造其他任何形式的坟墓。
禁止建造宗族墓地、家族墓地。
第三十条 少数民族公民死亡后按其丧葬习俗需要实行土葬的,应当在公墓、乡村公益性墓地埋葬。

第四章 丧事管理
第三十一条 殡仪活动应当文明、节俭,不得妨碍社会公共秩序、危害公共安全,不得侵害他人的合法权益,不得在丧事活动中从事封建迷信活动。
禁止在广场、公路、街道、学校等公共场所从事殡仪活动。
第三十二条 禁止制造、销售封建迷信丧葬用品。
禁止在逐步推行火化区以外的区域制造、销售棺木和其他土葬用品。
封建迷信丧葬用品的具体范围,由省民政部门会同省工商行政管理部门规定。
第三十三条 制造、销售丧葬用品、殡葬设备的,应当经民政部门审核,并向工商行政管理部门申领营业执照。
第三十四条 殡葬管理机构应当根据需要,建立殡仪服务点,健全服务规范,为丧主提供丧葬用品和服务。

第五章 法律责任
第三十五条 违反本条例规定,将应当火化的遗体土葬的,由死者生前居住地的民政部门责令自行改正;拒不改正的,可以强制火化,所需费用由当事人承担。土葬地乡(镇)人民政府应当予以配合。强制火化时,死者生前有工作单位的,原工作单位应当派人到场协助处理。
第三十六条 违反本条例规定,将骨灰装棺土葬或者建造宗族墓地、家族墓地,在公墓、乡村骨灰存放处、乡村公益性墓地以外的地方建造坟墓的,由民政部门责令当事人限期改正,逾期未改正的,组织平毁、迁移,当地乡(镇)人民政府应当配合进行工作。
迁移、平毁坟墓所需费用由当事人承担。
第三十七条 违反本条例规定,公墓、乡村公益性墓地接纳应当火化遗体土葬或者骨灰装棺土葬的,由民政部门责令限期改正,没收违法所得,可以并处三千元以上一万元以下罚款。
第三十八条 违反本条例规定,丧主擅自将遗体运出医院,医院不予制止也不向殡葬管理机构报告的,由民政部门对该医院处以五千元以下罚款,并可以由医院或者卫生部门对责任人给予行政处分。
第三十九条 违反本条例规定,未经审批擅自开办公墓、乡村骨灰存放处和乡村公益性墓地的,由民政部门会同规划、土地管理部门予以取缔,责令限期迁移已存放、安葬的骨灰、遗体,没收违法所得,可以并处违法所得一倍以上三倍以下罚款。迁移费用由公墓、乡村骨灰存放处和乡
村公益性墓地的开办单位承担。
第四十条 违反本条例规定,乡村骨灰存放处、乡村公益性墓地以营利为目的,从事经营性活动,接纳存放非本乡(镇)、村死亡人员骨灰的,由民政部门责令限期改正,没收违法所得,可以并处违法所得一倍以上三倍以下罚款。
第四十一条 违反本条例规定,公墓超面积建造墓穴或者超标准树立墓碑的,由民政部门责令限期改正,没收违法所得,可以并处违法所得一倍以上三倍以下罚款。
第四十二条 违反本条例规定,出售墓穴、骨灰存放格位和寿穴,倒卖墓穴和骨灰存放格位牟取非法利润的,由民政部门责令限期改正,没收违法所得,可以并处违法所得一倍以上三倍以下罚款。
第四十三条 违反本条例规定,制造、销售封建迷信丧葬用品或者在逐步推行火化区以外的区域制造、销售土葬用品的,由民政部门会同工商行政管理部门没收制成品及违法所得,可以并处制造、销售金额一倍以上三倍以下罚款。
第四十四条 在殡仪活动中有妨碍公共秩序、危害公共安全、侵害他人合法权益行为的,民政部门应当予以制止;违反治安管理的,由公安部门依法给予治安处罚;构成犯罪的,依法追究刑事责任。
第四十五条 国家工作人员、事业单位和国有企业单位职工违反本条例规定,影响恶劣的,除根据本条例给予处罚外,有关部门或者单位应当给予行政处分。
第四十六条 拒绝、阻碍殡葬管理人员依法执行公务,扰乱殡葬服务单位工作秩序,故意毁坏殡葬设施,或者侮辱、殴打殡葬管理人员和殡葬职工,违反治安管理的,由公安部门依法给予治安处罚;构成犯罪的,依法追究刑事责任。
第四十七条 民政部门、殡葬管理机构及其工作人员在殡葬管理中徇私舞弊、索贿受贿、滥用职权、玩忽职守的,由有关部门按管理权限对责任人给予行政处分;构成犯罪的,依法追究刑事责任。
第四十八条 殡葬服务单位及其工作人员不遵守殡葬职责和服务规范,出现重大事故或者造成不良影响的,由民政部门责令该单位限期整顿,由有关单位按管理权限对责任人给予行政处分。
殡葬服务单位工作人员利用工作之便索要、收受财物的,由民政部门责令退还,并根据情节给予行政处分;构成犯罪的,依法追究刑事责任。
第四十九条 在殡葬活动中违反土地管理、规划、林业等法律、法规的,分别由有关部门依法处理。

第六章 附 则
第五十条 香港特别行政区居民、澳门同胞、台湾同胞、华侨和外国人的丧葬事宜以及已建坟墓的有关事宜,按国家有关规定办理。
第五十一条 本条例自1998年1月1日起施行。1991年10月9日浙江省人民政府发布的《浙江省殡葬管理实施办法》同时废止。

第八届全国人民代表大会第一次会议根据《中华人民共和国宪法》第三十一条和第六十二条第十三项的规定,决定:
一、自1999年12月20日起设立澳门特别行政区。
二、澳门特别行政区的区域包括澳门半岛、氹仔岛和路环岛。澳门特别行政区的行政区域图由国务院另行公布。

宪法第三十一条规定“国家在必要时得设立特别行政区”,第六十二条规定全国人民代表大会“决定特别行政区的设立及其制度”。法律委员会建议,这次大会通过澳门特别行政区基本法时作出关于设立中华人民共和国澳门特别行政区的决定,并起草了决定(草案),规定:一、自1999年12月20日起设立澳门特别行政区;二、澳门特别行政区的区域包括澳门半岛、氹仔岛和路环岛。澳门特别行政区的行政区域图由国务院另行公布。
主席团常务主席审议同意将关于设立中华人民共和国澳门特别行政区的决定(草案)提请主席团审议决定提请大会审议。
